During the 2001 Regular Session, in an effort to address the societal costs of drunken driving and a high per capita prison population, the Louisiana Legislature amended the sentencing provisions of several criminal statutes, which amendments spawned appeals we consider this date. *fn1 Specifically, addressing itself to offenders of the driving-while-intoxicated statutes, the legislature declared that conviction of a third or subsequent DWI offense is presumptive evidence of a substance abuse disorder and that successful methods for treating addictive disorders are available.
